General Terms and Conditions of Sale
Preamble
The company RS ESTHETIQUE, owner of the brand RUTH NIDDAM PARIS, is registered under number RCS 492 015 672. Its postal address is 32 Avenue Matignon – 75008 Paris, and its email address is [email protected].
Any order for a product listed in the online store at https://www.ruthniddam.fr implies that the consumer (the “CUSTOMER”) has read and accepted these Terms of Use in advance. Clicking to confirm the order constitutes full acceptance of these terms and acts as a “digital signature.”
The General Terms and Conditions of Sale may be subject to change; the terms in effect on our SITE at the time the order is placed are those that apply.
Purpose
These General Terms and Conditions define the rights and obligations of the parties in the context of online sales of goods offered by the SELLER to the CUSTOMER.
Order Confirmation
The contractual information will be confirmed by email to the address provided by the CUSTOMER in the order form. Orders are considered final only after payment by the CUSTOMER has been received.
Order Modification
Any changes to an order (product, address, etc.) submitted more than 24 hours after payment confirmation will not be accepted.
Proof of the Transaction
Electronic records maintained in the SELLER’s computer systems under reasonable security conditions constitute proof of communications, orders, and payments between the parties. Archiving of purchase orders and invoices is done on a reliable and durable medium and may be produced as evidence.
Product Information
All efforts have been made to ensure the accuracy of the information presented on the SITE. However, the SELLER and its suppliers are not responsible for any consequences, incidents, or damages resulting from electronic transmissions or inaccuracies, even if the SELLER was aware of the possibility of such damages. Product and manufacturer names and brands are used solely for identification purposes. Product photos, descriptions, and prices are not contractual.
Prices
All prices are listed in Euros (€) and include all French taxes (VAT and other applicable taxes). The price indicated on the product page does not include shipping costs. Shipping fees vary depending on the destination country. The total amount due, indicated in the order confirmation, is the final price, including all taxes. Delivery rates applicable at the time of the order are available on the SITE.
Delivery Terms
Products are delivered to the address provided by the CUSTOMER in the order form (one address per order) and only within the areas we serve. All products leave our premises in perfect condition. The CUSTOMER must inspect the package for any signs of damage (holes, crushing, etc.) and, if necessary, refuse the package. In that case, an identical product will be sent free of charge.
The SELLER confirms and dispatches the order upon receipt of both the order and payment. Delivery is made to the CUSTOMER’s home or any address provided during ordering. The information provided by the CUSTOMER is binding. The SELLER is not responsible for delivery failures due to incorrect or incomplete address details.
If goods are returned due to incomplete address or unreported absence, the CUSTOMER has two options: – Reship the goods after payment of return costs, – Receive a refund of the order minus delivery costs.
Orders are delivered in a single shipment. Products declared damaged after receipt without prior note on delivery will not be exchanged. Orders can be tracked via Colissimo and are generally delivered within 8 days in Metropolitan France and 15 days for international shipments, excluding customs clearance. Delays over 15 days should be reported to Customer Service for investigation.
Delivery Errors
The CUSTOMER must report any delivery errors or non-conformity of products in type or quality to the SELLER on the day of delivery, or at the latest on the next business day. Claims submitted after this period will be rejected.
Complaints must be submitted to the SELLER’s address. Returns for exchange or refund must be in the original, intact packaging and reported in advance with the SELLER’s agreement. Shipping costs are covered by the SELLER except where the product does not match the CUSTOMER’s original declaration for return.
Product Warranty
Each product has an expiration date that must be respected. Some products must be kept away from heat and light. Please refer to the information on the SITE.
Right of Withdrawal
This right applies only to natural persons. Under Articles L. 120-20, the CUSTOMER has 14 calendar days to return products at their own expense if they do not meet expectations. The period begins on receipt of the order. All returns must be reported to Customer Service. Only products returned in their entirety, in original and intact packaging, and in perfect resale condition, will be accepted. Damaged products or products with altered packaging will not be refunded or exchanged. This right of withdrawal does not include shipping, packaging, or return costs. The CUSTOMER may request either a refund or an exchange. In case of exchange, shipping costs are borne by the CUSTOMER. Refunds are processed within 30 days.
Rights of Use
The use of trademarks on the SITE is strictly prohibited.
Force Majeure
Neither party shall be held liable for delays or failures caused by events beyond their control. Such events include, but are not limited to, transport blockages, natural disasters, strikes, network failures, or other unforeseeable circumstances. The affected party must notify the other within ten (10) business days. Parties shall meet within three (3) months, unless impossible, to determine how to continue contract performance. If force majeure lasts longer than one month, the contract may be terminated by the affected party.
Partial Invalidity
If any provision of these terms is deemed invalid by law or court ruling, the remaining provisions remain in full force.
Non-Waiver
Failure by either party to enforce any term shall not constitute a waiver of future enforcement.
Applicable Law
These terms are governed by French law. In case of dispute, the CUSTOMER should first contact the SELLER for an amicable solution.
Protection of Personal Data
All data provided are used solely to process orders. Under Article 27 of Law No. 78-17 (Jan 6, 1978), the CUSTOMER has the right to access, correct, and delete personal data. These rights can also be exercised online. This SITE is registered with CNIL under number 1534282 v0 (27-09-2011).
Disputes
Placing an order implies full acceptance of these Terms and Conditions of Sale. For legal entities, disputes relating to the sale (price, terms, products, etc.) are subject to French law before the Commercial Court of the SELLER’s registered office.
